Terms of Service

1. Acceptance
By creating an account or using Findly (the "app"), operated by Dynex bv (Belgium), you agree to these terms and to our Privacy Policy.
2. What the app does
The app lets family members share their live location with each other, view location history, set up notifications for arriving at or leaving places ("geofences"), and request another family member's current location on demand. It also lets any signed-in user create or join a temporary group — a time-limited location-sharing circle (for example, a trip or event) that shares only current position, not history, and is automatically deleted once it ends.
3. Signing in
You sign in with your phone number instead of a password. You're responsible for keeping access to that phone number secure — anyone who can receive your SMS verification codes can sign into your account. If you lose access to your number, contact Findly@dynex.be; note that changing your number currently creates a new account rather than transferring the old one (you'll need to be re-invited to your family/groups).
4. Families and groups are built on trust
This app works by design: once you're in someone's family or a group, you can see their location. You agree to:
- Only invite people to your family, or share a group's join code, with people who actually consent to sharing their location with you and the others in that family/group;
- Not use the app to track anyone without their knowledge or agreement;
- Not share a family invite code or group join code with anyone you haven't personally told about what it grants access to.
If you're a parent/guardian setting this up for a child, you're responsible for that setup and for explaining to them what's being shared and with whom.
5. Temporary groups — how they end
A group's creator picks, at creation, what happens when it ends: everything is deleted immediately, it goes read-only for a short grace period before deletion (during which the creator can extend it), or the member list is kept as a memento while location data is still deleted. Groups also have size, duration, and count limits that may change over time. Anyone in a group may share its join code with others (recruiting isn't limited to the creator); only the creator can rotate the code or end the group early.
6. Accuracy and reliability
Location reporting depends on your device's GPS, network conditions, battery-saving settings, and (particularly on iOS) how the operating system schedules background activity — delivery intervals are a target, not a guarantee, and can be delayed. Do not rely on this app for time-critical safety situations (for example, emergencies) — use appropriate emergency services instead.
7. Cost and availability
The app is currently free to use. If a paid tier is introduced in future, we will give notice and describe it before any charge applies. We may change, suspend, or discontinue features with reasonable notice where practical.
8. Acceptable use
You agree not to:
- Use the app to harass, stalk, or monitor anyone without their consent;
- Attempt to access another user's account or data without authorization;
- Reverse-engineer, scrape, or abuse the service (for example, automated sign-up attempts or SMS-verification abuse);
- Use the service for any unlawful purpose.
We may suspend or terminate accounts that violate these terms.
9. Disclaimer & limitation of liability
The app is provided "as is," without warranties of any kind. To the fullest extent permitted by law, Dynex bv is not liable for indirect, incidental, or consequential damages arising from your use of the app, including reliance on location data that turns out to be delayed, inaccurate, or unavailable. Nothing in these terms limits any liability that cannot be limited under Belgian or applicable EU law.
10. Changes to these terms
We'll update the "last updated" date above whenever these terms change, and post the new version at this same address. Continued use of the app after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of Belgium. Where you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
